Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Leisure Scout mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Leisure Scout is operated by Marc-Olivier Fortier, doing business as Leisure Scout ("we," "us," or "our"), registered in Quebec, Canada (NEQ: 2282166075).

2. Eligibility

You must be at least 13 years of age to use the App. Users between 13 and 17 years of age must have parental or guardian consent to use the App and to make any in-app purchases. By using the App, you represent that you meet these age requirements.

3. Description of Service

Leisure Scout is a mobile application that provides personalized suggestions for local leisure activities, events, and entertainment based on your stated preferences and location. The App aggregates publicly available event and venue information from third-party sources and uses artificial intelligence to curate recommendations.

4. Important Disclaimer — Activity Suggestions

By using this App, you expressly acknowledge and agree that:

• Leisure Scout is not responsible for the quality, safety, accuracy, availability, or suitability of any suggested activity, event, or venue
• Leisure Scout does not organize, operate, endorse, or affiliate with any third-party event organizer, venue, or service provider
• Event information (dates, times, prices, availability) is sourced from third parties and may be inaccurate, incomplete, or out of date — always verify directly with the event organizer or venue before attending
• Participation in any suggested activity is entirely at your own risk
• Leisure Scout is not liable for any injury, loss, damage, or harm arising from participation in any suggested activity or attendance at any suggested event or venue

You agree to independently verify all information before acting on any suggestion provided by the App.

5. User Accounts

You must create an account to use the App. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate account information
• Notifying us immediately of any unauthorized use of your account at hello@leisurescout.app

We reserve the right to suspend or terminate accounts that violate these Terms.

6. In-App Purchases

The App offers the following paid features:

• Ad hoc searches: $0.25 CAD per additional search when monthly limit is reached
• Prime subscription (coming soon): $2.99 CAD/month

All purchases are processed through Apple App Store or Google Play Store. By making a purchase, you agree to their respective terms of service. All sales are final unless required otherwise by applicable law.

Users under 18 must have parental consent for any in-app purchase. Parents are responsible for monitoring their minor children's use of in-app purchases.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code from the App
• Use automated tools to scrape, crawl, or extract data from the App
• Impersonate any person or entity
• Submit false or misleading information

8. Intellectual Property

All content, design, code, graphics, and the "Leisure Scout" brand name are the intellectual property of Marc-Olivier Fortier. The "Radar" mascot character and all associated artwork are proprietary assets of Leisure Scout. Unauthorized reproduction, distribution, or use of any App content is prohibited.

9. Third-Party Services

The App integrates with third-party services including but not limited to:

• SeatGeek (event data)
• Ticketmaster (event data)
• The Movie Database / TMDb (film information)
• Google Places (venue information)
• Anthropic Claude (AI recommendations)
• Supabase (data storage)
• Apple App Store / Google Play (payments)

We are not responsible for the practices, content, or availability of these third-party services. Their use is governed by their respective terms of service and privacy policies.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Leisure Scout's total liability to you for any claim arising from use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim
• For free users, this amount is $0
• We are not liable for any indirect, incidental, special, consequential, or punitive damages

This limitation applies regardless of the legal theory under which the claim is brought.

11. Indemnification

You agree to indemnify and hold harmless Marc-Olivier Fortier, doing business as Leisure Scout, from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

12. Privacy

Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Quebec, Canada.
